Seller Agreement

1. Introduction

This Seller Agreement defines the rules and obligations for users who list and sell items on Gemza. By creating a listing or offering an item for sale, the seller agrees to this Agreement.

2. Becoming a Seller

Sellers must be at least 18, provide accurate information, complete verification, and comply with all rules.

3. Seller Verification

Gemza may require ID, selfie/liveness, proof of address, bank verification, and fraud checks.

4. Listing Requirements

Sellers must provide accurate descriptions, real photos, honest condition reports, and disclose defects.

5. Prohibited Items

Counterfeits, stolen goods, weapons, adult content, hazardous materials, and illegal items are forbidden.

6. Auctions & Binding Sales

All bids are binding. Sellers must complete sales and may not cancel auctions to avoid low prices. Shill bidding is strictly prohibited.

7. Fees

Sellers agree to pay seller fees, payment processing fees, optional listing fees, and subscription fees. Fees are deducted from payouts.

8. Shipping Responsibilities

Gemza never holds or ships inventory — sellers ship every item directly to the buyer. Sellers set their own domestic and (if offered) international shipping rates, which are charged to the buyer at checkout and paid to the seller in full alongside the hammer price. Sellers must ship on time, package securely, use a reliable carrier, and upload tracking once a sale is paid. For cross-border deliveries, any import VAT, customs duty, or carrier handling fee is set by customs and the courier, is the buyer's responsibility to pay on delivery, and is never collected by Gemza or the seller as part of checkout.

9. Payouts

Payouts are released after delivery, buyer confirmation, dispute windows, and fraud checks. Gemza may delay payouts if risk is detected.

10. Disputes & Returns

Sellers must respond to disputes. Gemza may refund buyers if items are not as described. Returns may be required for misrepresentation, damage, or counterfeit goods.

11. Fraud Prevention

Gemza uses AI moderation, risk scoring, image hashing, and manual review. Sellers may not create multiple accounts, misrepresent items, or manipulate auctions.

12. Taxes

Sellers are responsible for reporting income and paying taxes.

13. Account Suspension

Gemza may suspend accounts for fraud, disputes, prohibited items, or rule violations.

14. Changes to This Agreement

Gemza may update this Agreement. Continued use means acceptance.

15. Daily Auction Room

The Daily Auction Room is a curated batch of items scheduled to go live and close together, alongside the regular marketplace. Submitting an item does not guarantee it will be listed: Gemza reviews and may approve, reject, or assign it to a future room at its discretion. Once approved, the seller must confirm the item is still available before that room starts; an item not confirmed in time is withdrawn and does not go live. Once a room starts, every item in it is an ordinary binding auction under this Agreement — the same bidding, fee, shipping, and payout rules above apply in full, with no separate terms.

16. Your Own Legal Compliance

Whether you are legally a "trader" subject to UK consumer protection law (including the Consumer Rights Act 2015) depends on your own individual circumstances — how regularly you sell, whether you buy items to resell, and similar factors — not on anything Gemza determines or controls for you. Complying with whatever legal obligations actually apply to your own selling activity, including any duty to consumers that cannot be excluded by a listing disclaimer such as "sold as seen," is your responsibility as the seller, not Gemza's. Gemza's own Buyer Protection Guarantee operates independently of this and does not change, replace, or limit whatever separate legal obligations, if any, apply to you.
