Terms of Service
1. Acceptance of terms
By creating an account or placing a bid on Gemsza, you agree to these Terms of Service. If you do not agree, do not use the platform.
2. What Gemsza is
Gemsza is an online marketplace connecting sellers consigning items with buyers bidding in timed auctions. Gemsza is not a party to the sale contract between buyer and seller, but provides tools — including automated AI checks — intended to support trust between them. Gemsza never takes title to, holds, or ships any item; every sale is fulfilled directly between buyer and seller.
3. The Daily Auction Room
Alongside the regular marketplace, Gemsza runs a Daily Auction Room: a curated batch of items scheduled to go live and close together. Submitting an item to the room does not guarantee it will be listed — Gemsza may approve, reject, or schedule it at its discretion, and the seller must confirm the item is still available shortly before the room opens or it is withdrawn. Once a room starts, every item in it is an ordinary auction under these Terms, with no separate rules.
4. Bidding and contracts
A bid is a binding offer to purchase at the bid amount. When an auction ends and the reserve (if any) is met, the highest bidder enters into a contract of sale directly with the seller. Buy-now purchases form a contract immediately upon payment.
5. Seller responsibilities
Sellers must accurately describe items, hold clear title, fulfil sales to the winning bidder, and ship the item directly to the buyer using a rate the seller sets themselves. Listings may be reviewed, delayed, or removed where our automated or manual review identifies a fraud, duplication, or quality concern.
6. Shipping, customs, and import charges
Shipping is arranged and fulfilled solely by the seller, never by Gemsza. The shipping cost shown at checkout is set by the seller and charged to the buyer alongside the item price. For deliveries crossing an international border, the destination country's customs authority or courier may additionally charge import VAT, duty, or a handling fee on arrival — these are set by customs, not by Gemsza or the seller, are payable by the buyer directly to the courier, and are never collected as part of a Gemsza checkout.
7. Fees and payments
Payment processing is handled by our third-party payment providers. Applicable seller fees, if any, will be disclosed before a listing goes live.
8. Prohibited conduct
Shill bidding, counterfeit goods, misrepresentation of condition or authenticity, and circumventing platform fees are prohibited and may result in account suspension.
9. Automated review — what our AI checks do (and don't do)
Before or shortly after a listing goes live, Gemsza runs it through an automated screening pipeline. This includes: (a) text screening of the title and description for prohibited content, known scam phrases, and unrealistic claims; (b) image comparison against other listings already on Gemsza, to catch photos reused or duplicated across the platform; (c) a price check comparing the listed price to a rough automated estimate and to other approved listings in the same category; and (d) a listing-quality score based on description length, image count, and completeness. Flagged listings may be held for human review before going live or remaining live.
10. What automated review is not
These checks are automated heuristics, not an expert appraisal, forensic image analysis, or authentication of any item's genuineness, provenance, condition, or the seller's right to sell it. They do not detect counterfeit logos, altered or manipulated photographs, product images copied from elsewhere on the internet, or misrepresentations not reflected in the listing's text or price. A listing that passes these checks — including one marked "Verified," or one covered by the Buyer Protection Guarantee — is not a representation by Gemsza that the item is authentic, as described, or free of fraud; it means only that the automated checks above did not detect a known pattern, or that a listing was manually reviewed and no issue was found at that time. The Buyer Protection Guarantee (see How It Works) is a limited contractual remedy offered at Gemsza's discretion, not a warranty of authenticity.
11. Limitation of liability
Gemsza provides the marketplace platform on an "as is" basis and is not liable for the condition, authenticity, shipping, or delivery of items sold between users, nor for any customs duty or import VAT charged on a cross-border delivery, except as required by law. This includes losses arising from fraud, misrepresentation, or counterfeit items that the automated or manual review described in Sections 9 and 10 does not catch — that review is a risk-reduction measure, not a guarantee, and does not make Gemsza a party to, or a guarantor of, any sale between a buyer and a seller.
12. Changes to these terms
We may update these terms from time to time. Continued use of Gemsza after changes take effect constitutes acceptance of the revised terms.
13. Who you're contracting with
Gemsza is operated by Raymond Doran, trading as Gemza / Gemsza, a sole proprietor based in Southend-on-Sea, United Kingdom.
